Facing Discrimination in the Workplace? 4 Things to Consider Before Filing Suit

In the workplace, most people are cordial and professional. But you'll occasionally run afoul of those who are inconsiderate and malicious. This is about more than just not getting along with coworkers. It's about being harassed and mistreated. You don't need to accept this abuse, but you do need to proceed carefully. These are four things to consider before filing a workplace discrimination suit.

How Are You Being Discriminated Against?


For a case to hold up in court, you need to provide actionable evidence of discrimination. You can't just say that you're being treated unfairly because you've been written up for being tardy when that happens to everyone who's tardy. You need to demonstrate exactly how you're being targeted for harassment based on factors such as age, race, or disabilities. Review employment discrimination law for confirmation that your case is valid.

Have You Filed a Complaint?


A discrimination suit should be your last resort. When you're being discriminated against in the workplace, you should first turn to your boss or human resources department to file a complaint. Make it as specific as possible. The responsible parties should be reprimanded and/or terminated.



If no action is taken and the discrimination continues, then you shouldn't definitely move forward with a suit.

Can You Afford It?


Legal battles can be costly. A victory will help with legal fees, but there's still a lot of financial considerations to be made. Consider your current expenses and whether you can take on the burden of legal fees. There are ways to make it more affordable, such as taking out settlement loans. You can also discuss working on a contingency basis with your lawyer in which payment is made on the basis of a won or settled case.

Are You Prepared For the Emotional Toll?


Lawsuits can drag on for a long time and take a lot out of you. Until the case is won or settled, you're going to spend much of your time preparing with your lawyer. This can keep the abuse you suffered lingering longer than you anticipated. Be honest with how much of an emotional toll this is going to put on you. If you believe in it enough, you should keep on fighting.

The experience of workplace discrimination can be incredibly draining, and the stress can amplify when you file a suit. To lessen the pressure on you, make sure that you have everything in order and that you are taking care of yourself. You have every right to be treated with dignity in the workplace. Filing a suit sends a powerful message that you won't be trifled with.
