PEAK SPORTS' ATTORNEY ISSUES LETTER REFUTING HBCU AD'S STATEMENTS

Peak Sports, represented by attorney Cooper Walker of Frost Echols, has formally responded to recent statements made by Dr. Skip Perkins, the Athletic Director at North Carolina Central University (NCCU). Perkins made several claims during a board meeting on June 25, 2024, which Peak Sports believes to be inaccurate and potentially damaging to their reputation.
In a letter addressed to the NCCU Board of Trustees and the Office of the Chancellor, Walker disputes Perkins' assertions regarding the contractual relationship between NCCU and Peak Sports. Perkins reportedly stated that Peak Sports receives 40% of all sales revenue, regardless of whether the items were sold by Peak Sports or the institution itself. Additionally, Perkins claimed that NCCU has made multiple attempts to terminate the contract.

Walker clarified the actual terms of the agreement, which differ significantly from Perkins' statements. According to Walker, NCCU retains 100% of revenue up to $100,000 annually. For revenue between $100,000 and $275,000, Peak Sports receives 100% of the revenue, and any revenue beyond $275,000 is split, with 60% going to NCCU and 40% to Peak Sports. This contradicts Perkins' assertion that Peak Sports receives 40% of all sales.


Furthermore, Walker pointed out that the original contract did include a provision where Peak Sports received 40% of all items sold by NCCU, but this clause was amended on May 5, 2023. The amendment, signed by Perkins himself, allowed NCCU to raise funds independently without owing a share to Peak Sports. Therefore, Peak Sports only benefits from sponsorships it directly secures.

Regarding Perkins' claim about attempts to terminate the contract, Walker clarified that there was only a single inquiry made by Perkins on April 30, 2024, about the possibility of terminating the agreement. There were no subsequent formal attempts or repeated discussions on the matter.

In his letter, Walker emphasized that Peak Sports values its partnership with NCCU and holds no animosity towards the institution. However, he expressed concern over the potential impact of Perkins' public statements on their professional reputation. While Peak Sports does not currently intend to pursue legal action, they requested that the inaccuracies be corrected in the Board's official records and addressed in the next Board meeting.

Walker concluded by stressing the importance of transparency and accuracy in public communications to uphold the integrity of their professional relationship with NCCU. Peak Sports hopes for a resolution that reaffirms their commitment to supporting NCCU Athletics through productive collaboration.

The response from NCCU Athletics to these developments was sought by HBCU Gameday but declined to comment at the time of the report.
