This information is from an Election Lawyer, not the press, not some article I read and certainly not from the man in the street!

Myth:Voter going through foreclosure can't vote.

Truth: If the foreclosure process is NOT COMPLETE, you can vote at your address, and homeless people can vote at the address where they live if in a shelter.

Myth: Felons are barred from voting for life.

Truth : in New Jersey, They can re-register when off parole or probation, and if you have misdeameanors from other states, they can register if they are on probation.

Myth: Voters wearing Obama gear will not be allowed to vote.

Truth: NO official has the right to tell you to leave. Understand that a polling place is a "federal substation if you will" and they have have authority. They can ask you to cover it, remove or take off or leave and come back. Reason: no electioneering is allowed within 100 feet, and your Obama gear is considered advertising for Obama. that is all. Keep it simple. Cover it up. Don't make us look bad. If you must celebrate, walk 110 feet away and you can wave your shirt in he air, all day long! (smile)

Myth: The light was on for McCain when I walked in, I am worried the machine was rigged.

Truth: That's because in the Sequoia machines,the person before you forgot to press the cast your vote button, ask the poll worker to clear it.

Myth: I accidentally chose McCain,and now I can't change it to Obama..I think the machine is rigged.

Truth: With Sequoia machines, in N.J. you have to unselect Twice to extinguish the light,then proceed.

Myth: You have to punch Barack's name first, then punch "Straight Democratic" or the vote won't count.



Truth: The Sequoia Advantage, machines,used in 19 counties in New Jersey, have no straight ticket button at all and all candidates must be individually selected.

MYTH: WHEN VOTERS ARE NOT IN THE BOOK OF REGISTERED VOTERS THEY CANNOT VOTE.

Truth: If you don't have ID, go home and get it , or fill out a PROVISIONAL BALLOT and send , bring or fax ID to county election officials at least by the second day ,Nov 6, by close of business. Bring ID: bills, bank statements, pay checks, utility bills of course your driver's lic, they are checking name and address.

Myth: If you get sick on Election day you can't vote.

Truth: A voter can get a vote in by emergency ballot, and a Judge's order. This is where these attorneys for Obama come in, they will be at the poll site or a rep will be there, and can be called through the Obama campaign office in your town or nearest you. The messenger must be a family member of the sick person,or a registered voter, in the applicable county.

Myth: Voters can be challenged for any reason.

Truth: It is a federal crime to challenge someone because of race, national origin, residence,housing complex. If the challenger and poll official agree then affidavits must be signed citing the grounds so the voter can with the attorneys available go to the Court to seek an order to be allowed to vote.

Myth: College students cannot vote at their college address:

Truth: They can vote at either, but not home and college if away from home.

Myth": If you are not AT the voting machine by 8:00 p.m. will not be allowed to vote.

Truth: Everyone waiting in line when the polls close, at 8:00 p.m. MUST be allowed to vote. A poll worker will come to the end of the line at 8:00 p.m. in New Jersey.

Good luck everyone, if anyone you know has a problem, call an Obama office near you go to polls and find an Obama Protection Volunteer.

I have a question about the Myth: Voter going through foreclosure can't vote. There is another segment to that. Because my husband helps people in foreclosure. The foreclosure process can be complete as long as the house has not been auctioned off and the residents have not been evicted. Here in Florida due to the massive homes sold at auction it could take up to 30-days or more after the foreclosure for the eviction.

Hi Darlene, I don't understand your response/concern? let me clarify, "if you have not been evicted" and you still reside there, you can vote there. Because you are "residing" there just as you would in a nursing home, homeless shelter or halfway house. Either the paperwork is in process, your home has been auctioned off and that is part of the process, but if you reside there that is your residence, because it falls under the rights of tenants, tenancy is 9/10th of the law. There appears to be a contradiction in the statement, that the process is completed, but it is occupied--and they have not been evicted. So therefore based on what you stated, without looking at Florida Real Estate law,anyone who is still residing in their former home and has not been offcially evicted by a Judge's order, is a resident. And any attempt to supress that voter's right, can be challenged, and till that voter has a right to sign a "provisional" ballot until the voter protection lawyers make an application to the court.
Each situation will be on a case by case, scenario.
