Woman Sues Kmart Over Toilet Paper TaxFriday, October 5, 2007
PITTSBURGH - A woman has sued Kmart for allegedly collecting a 7 percent state sales tax on a nontaxable item: a 12-pack of toilet tissue. Mary Bach alleges a Kmart department store in the Pittsburgh suburb of Monroeville improperly collected the tax on the $3.99 item, charging her $4.27 - or 28 cents too much.
Although most paper goods are taxable under Pennsylvania's sales tax code, toilet tissue is listed as a nontaxable item by the state Department of Revenue.
Bach told the Pittsburgh Post-Gazette she was overcharged for the item at the same store twice before she filed the small claims suit last month in district court in Monroeville.
She is seeking $100 in damages plus court costs for the alleged violation of the state's Unfair Trade Practices and Consumer Protection Law. Under the law, plaintiffs can **** for the amount of the damages or $100, whichever is greater, said Bach, of Murrysville.
A Kmart spokesman did not immediately return a call seeking comment Friday.
Kmart stores are operated by Illinois-based Sears Holdings Corp.

Police chief: Teen shoots four, kills self at Cleveland high school - October 10, 2007It was only after a crowd of screaming students ran past Darnell Rodgers in a stairway at his Cleveland, Ohio, high school Wednesday afternoon that he realized he had been shot.
"They were screaming, 'Oh my God! Oh my God,'" said Rodgers, a senior at SuccessTech Academy near downtown Cleveland.
Rodgers suddenly felt his arm "burning," he said, and realized he had been shot in the elbow.
Police have started to piece together what happened.
At around 1:15 p.m. ET, 14-year-old **** Asa ****, who was a student at the school, walked the halls firing a gun in each hand, Cleveland Police Chief Michael McGrath said.
When it was all over, five people had been shot, but the only fatality was ****, who police said **** himself in a classroom.
Police found a .22- caliber revolver and .38-caliber revolver near ****'s body, along with a box of ammunition and three ****, said McGrath.
Investigators have reason to believe some victims were specifically targeted by ****, who had been suspended from school Monday.

There were no metal detectors that day...I know where the school is and have been there several times...they used to have metal detectors but the students are not required to pass through them, they go through a separate entrance...but my prayers go out to the boy's family...for real...
Mychal Bell of 'Jena 6' ordered to juvenile facility
A black Louisiana teenager at the center of the racially charged "Jena 6" case was ordered Thursday to spend 18 months in a juvenile facility, after a judge ruled he had violated his probation for earlier juvenile convictions, a source with knowledge of the court proceedings said.
Mychal Bell, 17, who was freed two weeks ago after his adult criminal conviction for beating a white classmate was overturned, was sent to the Renaissance Home for Youth in Alexandria, Louisiana, the source said.
The decision came at the end of a two-day juvenile court hearing that was closed to the media and public.
Carol Powell-Lexing, one of Bell's attorneys, said the judge's decision would be appealed.
Bell was freed on $45,000 bail on September 27, after an appeals court threw out his conviction on battery and conspiracy charges in adult court and remanded the case to juvenile court.
But Judge J.P. Mauffrey agreed with prosecutors that Bell had violated the probation he was given for four previous juvenile offenses, including two simple battery charges, the sources said.
Bell had been placed on probation until he turned 18.

INDIANA, Pa. - The long-standing rivalry between Coke and Pepsi took a physical turn Friday when a Pepsi deliveryman allegedly punched his Coke counterpart in the face at a western Pennsylvania Wal-Mart, state police said.
The two deliverymen were "apparently bickering back and forth" while unloading their wares at the Indiana County store, police said. When the Coke deliveryman left the store, his counterpart allegedly punched him in the face three times, breaking his nose and giving him a black eye, police said.
No charges have been filed, but police characterized the incident as a misdemeanor simple ****.
